FY 2025 H-1B Regular Cap: Second Random Selection from Pre-Submitted Registrations Completed

USCIS has completed the second random selection for the FY 2025 H-1B cap. This selection focused exclusively on regular H-1B CAP registrations, enabling potential petitioners to file H-1B cap-subject petitions for the beneficiaries listed in the selected registrations. To meet the FY 2025 H-1B regular cap numerical allocation, USCIS needed to select additional registrations to ensure a sufficient number of unique beneficiaries were included. Petitioners with selected registrations can only file cap-subject petitions for the beneficiary specified in the registration notice, and they must include a copy of the selection notice with their petition, which must be submitted by November 2024.

To secure approval, petitioners must demonstrate their eligibility under all applicable laws and regulations. USCIS released a final rule on January 31, 2024, which revised the fees for most immigration petitions and applications. The updated Form I-129, Petition for a Nonimmigrant Worker, became available on April 1, 2024. Additionally, the final rule for premium processing fees was announced on February 26, 2024, increasing the filing fee for Form I-907 to account for inflation.

In summary, the FY 2025 H-1B cap selection process has now ensured a sufficient pool of beneficiaries, and petitioners must adhere to the updated requirements and deadlines to successfully file their petitions. Compliance with the revised fees, forms, and regulations is critical for obtaining H-1B approval within the specified timeframe.
