The EB-5 Immigrant Investor Program, established under Section 203(b)(5) of the Immigration and Nationality Act, provides eligible foreign investors with the opportunity to obtain lawful permanent resident status in the United States by making a qualified capital investment in a new commercial enterprise. The minimum investment amount is currently $1,050,000, or $800,000 if the investment is made in a Targeted Employment Area (TEA)—a rural or high-unemployment area as designated by USCIS. To qualify, the investor must demonstrate that the investment will create or preserve at least 10 full-time jobs for qualified U.S. workers within two years. Upon approval, the investor and their immediate family (spouse and unmarried children under 21) are granted conditional permanent residency for two years.
The EB-5 Reform and Integrity Act of 2022 introduced critical regulatory enhancements, particularly impacting the Regional Center Program, which pools investor capital for large-scale projects. The Act reauthorizes the program through September 30, 2027, and imposes several new compliance requirements, including submission of Form I-956 for center designation or amendment, payment of annual Integrity Fund fees, and participation in mandatory compliance audits every five years. These reforms are designed to enhance the program’s integrity, ensure greater transparency, and strengthen oversight—while maintaining its core investment and job creation mandates.
Despite these changes, investment through USCIS-designated Regional Centers remains the most popular route due to its passive nature and flexibility in fulfilling job creation requirements, including indirect employment. Nevertheless, potential investors are strongly advised to conduct thorough due diligence when selecting a Regional Center to ensure full regulatory compliance. When strategically planned, the EB-5 Visa continues to serve as a reliable and efficient path to permanent U.S. residency through meaningful economic contribution and employment generation.
