H-1B Cap Petition Filing Requirements and Deadlines

After selection in the H-1B cap lottery, employers must submit Form I-129, the H Classification Supplement, and the H-1B Data Collection and Filing Fee Exemption Supplement in compliance with USCIS regulations. The petition should include the H-1B Registration Selection Notice, the beneficiary’s passport or travel document, and a certified Labor Condition Application (LCA) reflecting the same job details. Any discrepancies between registration and petition must be explained with supporting documentation.

Petitioners must use the latest USCIS forms, complete them accurately, and ensure they comply with signature requirements. The petition should specify a requested employment start date of October 1 or later and within six months of filing. Filing can be done online or via paper submission, but paper submissions cannot be linked to the online account.

For FY 2026, the filing window is April 1–June 30, 2025. Petitions received outside this period will be rejected. Due to high demand, employers are encouraged to prepare early, ensure data consistency, and consult legal counsel to avoid rejection or denial.
