USCIS has completed the FY 2027 H-1B lottery and selected enough electronic registrations to meet the annual cap, including the advanced degree exemption. Selected beneficiaries have been notified through their registrants’ online accounts, and only those selected are eligible to file H-1B cap-subject petitions. Filing begins April 1, 2026, and must occur within the specified filing window of at least 90 days. Petitions must include the selection notice, use the new Form I-129 (02/27/26 edition), and be filed at the correct location or online. The petition must match the original registration details, and employers must submit supporting evidence such as the beneficiary’s passport used during registration and proof of the wage level selected.
Selection does not guarantee approval, and petitioners must still establish full eligibility as required by USCIS. If a registration was not selected, no action can be taken unless USCIS conducts a second lottery. Additionally, certain H-1B petitions filed on or after September 21, 2025, may require an additional $100,000 payment under a presidential proclamation. Petitioners must ensure all documentation is complete and accurate, as errors or inconsistencies with the original registration can lead to rejection or denial.
